Article 1

 

The Grand Duke (hereinafter: the Sovereign) is the official head of state. The sovereign is inviolable, he cannot be forced to resign the throne. The Sovereign, or his appointed representative, is empowered to sign treaties with other nations. The Sovereign appoints and dismisses his ministers. The Sovereign is the commander-in-chief and bestows military ranks. The Sovereign appoints and dismisses ambassadors. The Sovereign has the right to grant and implement "honorary" and "residential" citizenship, or allow members of his ministry to do so. The Sovereign may deny, prohibit, or remove visitors, honorary citizens, or resident citizens who have violated, or intend to violate the Royal Grand Duchy constitution, or its territorial laws, or who have committed crimes within other jurisdictions. The Sovereign has the right to bestow titles of nobility in corporation with the Daviterra Institute for Nobility & Heraldic. The Sovereign and members of the royal family have no right to financial provisions from the Government, but as owner of the property, deed, and name rights, may establish and collect fees from Daviterra Nation/Royal Grand Duchy endeavors, as well as collect all fees associated with the " citizenship investment", required by all in-coming "residents". The sovereign shall create a treasury and establish the design, value, and circulation of Royal Grand Duchy Currency. The National Anthem shall be written and composed at the direction of the Sovereign. The national symbol(s), designed by the Sovereign,  (in prominent display): The Royal Grand Duchy Flag and the equally-distinctive Royal Emblem, as well as the  Coat of Arms are to be applied in official representation and correspondence. As a matter of order, assigned individuals shall direct the daily operations of the community through the Sovereign's appointment of its cabinet's Ministers, each with the policies and procedures, as established by the Sovereign. For any proposed legislation to become law, the Sociocratic practices and transparencies shall be followed, while mandating that the Sovereign give their Royal Assent, to both the proposed and the passed law, which can be given in person verbally, in writing, or through the affixing of Royal Seal or signature. The Sovereign has sole power to amend the constitution with or without consultation or debate,. The constitutional powers of the Sovereign shall continue through the natural and legitimate offspring within the direct line, or heirs, of Grand Duke David of Daviterra. Should no offspring exist, or should those existing in succession, be unwilling to continue in the Royal Duties, after the death of the Sovereign, the successor will be elected by a special royal college that consists out of all members of the royal family, the Grand Ducal Cabinet and all registered Daviterra nobles. The Sovereign carries no crown, but may show other royal regalia.

 

 

Article 2

 

(Sociocracy) as a form of governance or management, presumes equality of individuals and is based on consensus. This equality is not expressed with the "one man, one vote" law of democracy but rather by a group of individuals, assign to a specific task and responsibility. Such groups, or "circles", shall be designated as "Ministries", reasoning together until a decision is reached that is satisfactory to each one of them.

To make Sociocratic ideals operational, decisions are made by everyone working together in weekly "talkovers" for each respective ministry, to find a mutually acceptable solution. The individuals in each Ministry would then agree to abide by the decision. "Only when common agreement is reached can any action be taken, quite a different atmosphere is created from that arising from majority rule."It is defined by three "fundamental rules": (1) That the interests of all members must be considered and the individual must respect the interests of the whole. (2) No action could be taken without a solution that everyone could accept, and (3) all members must accept these decisions when unanimously made. If a group could not make a decision, the decision would be made by a "higher level" of representatives, known as the Minister, chosen by the Sovereign. The size of a decision-making group should be limited to 40 with smaller committees of 5-6 making "detailed decisions." For larger groups a structure of representatives is chosen by these groups, with endorsement by the Sovereign, to make decisions. All discussion and decision procedures related to Royal Grand Duchy legal, and operational matters, shall be over-seen by the Sovereign, or an appointed representative.  

 

 

Article 3

Royal Grand Duchy Daviterra shall provide, protect, and preserve the common welfare of its citizens. All Daviterrans,  citizens of Royal Grand Duchy Daviterra,  have equal "rights of dignity" and are equal before the law, without distinction of gender, race, language, religion, sexual orientation, sexual (self) assignment, political opinion, physical or mental capacity, personal or social conditions, or national origin. Quality and comprehensive education, child care, suitable and safe housing, equal and equitable access to employment and economic advancement, fair and reasonable judicial process and penalties, basic nutrition standards, environmental safety, pre and post natal care, reproductive safety and support, birth control in all its medical-endorsed forms, general lifetime healthcare, as well as medical-assisted suicide, are all ratified, cemented in our foundation of "Joy and Justice". The job of Royal Grand Duchy Daviterra is to remove obstacles to economic and social potential, identified as constraining the freedom and equality of citizens, which in turn prevent full development of the human person and their effective participation in the political, altruistic, and economic functions of the nation.

 

Article 4

 

Royal Grand Duchy Daviterra recognizes all citizens/Daviterrans, of legal age, as mandated by the state, the right to work and promotes conditions that make this right effective. Every citizen over the age of 18 has a duty to perform according to their ability and individual choice, activity or function that contributes to the material or spiritual progress of society. Every citizen, as required through statute and citizenship agreement, shall be required to commit some regular time to volunteering as a function of supporting the daily operations and needs of the community that is Royal Grand Duchy Daviterra.

 

Article 5

 

Royal Grand Duchy Daviterra, prohibits individual possession of any and all ballistic, or other projectile weaponry. Royal Grand Duchy Daviterra shall store and maintain a well-stocked arsenal through various ownership of said weaponry, for the safety and collective protection of its citizens.  

 

Article 6

 

Royal Grand Duchy Daviterra first language shall be English, but protects linguistic and cultural minorities with special rules.

 

Article 7

 

Royal Grand Duchy Daviterra recognizes other states and MicroNations, each in its own independent and sovereign entity, by reports of alliance, trade, and cooperation.

 

Article 8

 

Royal Grand Duchy Daviterra supports freedom "of" religion for individuals, but also enforces freedom "from" religion as a national policy. Although no "religion" shall be established, endorsed, or sanctioned, by the Sovereign, or Royal Grand Duchy Daviterra, the only official and solely recognized "church" of Royal Grand Duchy Daviterra, is "The Guardians Of Divinity Church", a nondenominational congregation, and it shall be allowed to use designated sites for regular gatherings, as administered by the Sovereign.  Neither the Sovereign, Royal Grand Duchy government, nor its citizens, shall establish, condone, promote, or preach a religion. Neither shall the Sovereign, Royal Grand Duchy government permit any ideology, edict, philosophy, or concept, which portrays individuals, or groups of individuals, as "less than", in demonizing terms, or refer to such persons in a threatening manner.

 

Article 9

 

All citizens of Royal Grand Duchy Daviterra are entitled to freely express their thoughts in speech, writing or any other means of communication. Neither individuals, nor the press, shall be subjected to authorization limitations, or censorship, except when manifested in forms of slander, malice, fabrication of facts, opinions given as fact, or in violation of Article 8.

 

Article 10

 

The Royal Grand Duchy Daviterra legal system conforms to the generally recognized rules of international, United States federal, and Nevada state law, as well as local community standards. The legal status of foreigners is regulated by law in conformity with international standards and treaties.

 

Article 11

 

Royal Grand Duchy Daviterra rejects war as an instrument of aggression against the freedom of other peoples and as a means of settling international disputes. It permits self-defense,  as a means of a deterrent, the limitations set by a sovereignty, which is necessary for an order that ensures peace and justice between nations, that in turn, promotes and encourages cooperation between international organizations having such mutual non-threatening intentions.

 

Article 12

 

Every citizen may freely move and reside anywhere in the country, except the limitations established by the law generally for reasons of health or safety. No restrictions may be made for political reasons. Every citizen is free to leave the territory of Royal Grand Duchy Daviterra, and re-enter, unless restricted by law. Each citizen/family's member shall be granted continued residency with the fulfillment of monthly fee requirements,  as stipulated by the citizenship agreement.

 

Article 13

 

Citizens/Daviterrans, have the right to associate freely, without authorization, for purposes not prohibited by criminal law. Secret associations are prohibited. Citizens have the right to assemble peaceably and unarmed. Meetings in public, where notice must be given to the authorities, may be prohibited, for reasons of security or public safety, or in violation of Article 8. 

 

Article 14

As stipulated  by the Sovereign, all citizens of Royal Grand Duchy Daviterra, have the right to freely contribute through the Sociocratic procedures, to determine aspects of Daviterran legal, socioeconomic, and political policy, as set-forth by the Sovereign. All participants, men and women who have come of at least 16 years of age, will have their input considered as personal, equal, and freely-given. Its exercise is a civic duty. All citizens of 18 years, or older, are eligible for public ministry offices and for elective or appointed positions on equal terms, according to the requirements established by Daviterran law. The Sovereign and public offices, shall provide communication channels with respect to current events and policy updates to Daviterra citizens.

 

Article 15

 

Royal Grand Duchy Daviterra respects the sanctity of life. All beings, human, as well as wild, and domesticated animals, shall be treated with compassion, and dignity. No physical, emotional, or abusive neglect, intentional, or otherwise, of such living entities, shall be tolerated.
